The European Court of Human Rights (“ECHR”) declared its first judgment (numbered 33399/18) on dismissals of civil servants under the Statutory Decree No. 667 (‘Decree’) during the state of emergency period in Turkey on 15 December 2020.
As a result of the individual application made by the civil servant who was dismissed due to the Decree, the ECHR ruled that there was a violation of human rights.
In its justified decision, the ECHR stated that the applicant’s right to a fair trial and the rights to respect for private and family life have been; and Turkey was sentenced to pay EUR 4,000 as a compensation for the applicant’s of non-pecuniary damage.
